Guest Participation Agreement, Assumption of Risk & Release of Liability

Please read carefully. This is a legal document that affects your legal rights. I, the adult signing below, acknowledge and voluntarily agree to the following for myself and for each child/minor listed above:

1. Inherent risks. I understand that using inflatable bounce houses, combos, and slides involves inherent risks, including but not limited to falls, collisions with other participants, impact with the inflatable walls, floor, or ground, falling off or out of the unit, landing awkwardly, sprains, fractures, dental injuries, head, neck, and spinal injuries, concussions, entanglement, overexertion, deflation or equipment movement, and the actions of other participants. These risks may result in minor or serious bodily injury, permanent disability, paralysis, or death, as well as damage to personal property.
2. Voluntary participation. Participation is completely voluntary. I choose to participate and/or allow the minors listed above to participate with full knowledge of these risks. I may stop participation at any time, and I will stop participation for myself or my minors if conditions, health, or behavior become unsafe.
3. Safety rules. I and my listed minors will follow all posted, written, and verbal safety rules and instructions from Your Klaus Bounce Houses and the party host, including: no shoes, glasses, sharp objects, jewelry, food, drinks, gum, silly string, or toys inside the unit; no flips, wrestling, pushing, climbing walls or netting, or hanging on the unit; no going down slides head-first or standing on slides; only similar-sized participants at the same time; and following occupancy limits. I will exit the unit immediately if it begins to deflate, if instructed to, or if weather becomes unsafe.
4. Supervision of minors. I accept full responsibility for supervising the minors listed above at all times. I understand that Your Klaus Bounce Houses does not provide on-site attendants or supervision during the party unless separately agreed in writing, and that the party host does not assume responsibility for supervising my minors unless I have specifically arranged it.
5. Health and fitness. I confirm that I and each listed minor are in good health and have no medical condition, injury, pregnancy, heart condition, recent surgery, or other condition that would make participation unsafe. I will not participate, and will not allow my minors to participate, while ill, injured, or under the influence of alcohol, drugs, or medication that may impair judgment or coordination.
6. Parent/guardian authority. I confirm that I am the parent or legal guardian of each minor listed above, or that I have been given legal authority by the parent or guardian to sign on the minor's behalf. I have explained these rules and risks to my minors in terms they can understand.
7. Assumption of risk. I knowingly and voluntarily assume all inherent risks of participation, both known and unknown, for myself and the minors listed above, even if arising from the ordinary use, condition, or operation of the equipment.
8. Release and waiver of claims. To the fullest extent permitted by applicable law, I, for myself, my listed minors, and our heirs, executors, and representatives, release, waive, and agree not to sue Your Klaus Bounce Houses, its owners, employees, contractors, and representatives, and the party host who rented the equipment (collectively, the "Released Parties") for any claims, injuries, losses, or damages arising from the inherent risks of participation or the ordinary use of the equipment, except for claims or rights that cannot legally be waived, such as those resulting from gross negligence or intentional misconduct.
9. Indemnification. To the extent permitted by law, I agree to indemnify and hold harmless the Released Parties from any claims, losses, damages, or expenses, including reasonable attorney fees, brought by me, my listed minors, or any third party that arise from my breach of this agreement, my or my minors' failure to follow safety rules, my failure to supervise, or our misuse of the equipment.
10. Property and equipment damage. I accept responsibility for damage to the rental equipment or to the property of others caused by intentional acts, misuse, prohibited items, or failure to follow rules by me or my listed minors, excluding ordinary wear and tear. Your Klaus Bounce Houses and the party host are not responsible for lost, stolen, or damaged personal belongings.
11. Medical treatment. In the event of an injury or emergency, I authorize the Released Parties to call emergency services and to arrange reasonable first aid or emergency medical treatment for me or my listed minors if I cannot be reached. I understand that I am responsible for all medical costs for myself and my minors.
12. Incident reporting. I will report any injury, unsafe condition, or equipment problem to the party host and to Your Klaus Bounce Houses as soon as reasonably possible.
13. Governing law and severability. This agreement is governed by the laws of the State of Utah and is intended to be as broad and inclusive as Utah law permits. If any part of this agreement is held invalid or unenforceable, the remaining parts will continue in full force and effect.
14. Duration. This agreement applies to this party and to any later use of Your Klaus Bounce Houses equipment at this same event, including setup delays or extended rental time.

By signing, I confirm that I have read and fully understand this agreement, that I am giving up substantial legal rights, that the information I provided is accurate, that I am at least 18 years old and legally able to enter this agreement, and that I sign it freely and voluntarily without any inducement.
